1. Acceptance of Terms

By scanning the QR code, accessing or using the promotional website, submitting your information, and/or spinning the digital prize wheel (the “Promotion”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as any applicable Privacy Policy, Notice at Collection, and Cookie Notice made available in connection with the Promotion.

2. Eligibility

This Promotion is open only to legal residents of California who are eighteen (18) years of age or older at the time of participation. Sponsor may require valid government-issued photo identification before allowing redemption of any offer, voucher, discount, or prize. Employees, officers, directors, managers, agents, representatives, and immediate family members of 24th Street Bingo, and any of its affiliated entities involved in the administration of this Promotion, are not eligible to participate.

3. No Purchase Necessary to Participate

No purchase or payment of any kind is necessary to access the website or spin the digital wheel. Participation in the Promotion does not guarantee receipt of any particular prize, discount, or offer. Odds of receiving any particular offer depend on the rules, settings, and availability established by Sponsor in its sole discretion.

4. Information Submitted; Consent to Contact

By entering or submitting your information in connection with this Promotion, you expressly authorize Sponsor to use the information you provide, including your name, email address, mobile telephone number, device identifiers, IP address, and other information collected through the Promotion, for the following business and commercial purposes:

administering the Promotion;
delivering vouchers, prizes, promotional codes, confirmations, and service-related communications;
sending marketing, advertising, and promotional communications from Sponsor by email, SMS/text message, telephone call, and other lawful communication methods;
personalizing offers, promotions, and user experience;
measuring engagement, campaign effectiveness, and conversions;
fraud prevention, security, recordkeeping, compliance, and enforcement of these Terms.

Where you provide your mobile number and affirmatively consent to receive text messages, you agree that Sponsor may send you recurring promotional and transactional SMS/text messages, including messages sent using an automated system or prerecorded technology where permitted by law. Message frequency may vary. Message and data rates may apply. Consent is not a condition of purchase. You may revoke text consent at any time by replying STOP, or by using any other reasonable method made available by Sponsor. Email marketing communications may be unsubscribed from through the unsubscribe mechanism included in the email or by contacting Sponsor as provided in the applicable Privacy Policy. Sponsor will process opt-out requests in accordance with applicable law.

5. Privacy, Cookies, Tracking Technologies, and Advertising

By using the promotional website, you acknowledge that Sponsor and its service providers may collect personal information and internet or other electronic network activity information through cookies, pixels, tags, SDKs, analytics tools, session replay tools, and similar technologies for the purposes described in Sponsor’s Privacy Policy, Notice at Collection, and Cookie Notice, including analytics, site functionality, fraud prevention, remarketing, and advertising.

To the extent required by applicable law, Sponsor will provide applicable notices and consumer choices concerning cookies, sale, sharing, cross-context behavioral advertising, and the use or disclosure of sensitive personal information. Nothing in these Terms waives any rights a consumer may have under applicable privacy law. If you are a California resident, you may have the right to request access to, correction of, deletion of, or limitation regarding certain personal information, and the right to opt out of the sale or sharing of personal information, as described in Sponsor’s Privacy Policy or Notice at Collection.

6. Third-Party Service Providers and Marketing Partners

Sponsor may use third-party vendors, platforms, agencies, analytics providers, ad networks, texting platforms, email platforms, CRM providers, and other service providers to administer the Promotion, communicate with participants, deliver ads, measure performance, and support business operations. Sponsor may also disclose information to affiliated entities and marketing partners to the extent permitted by applicable law and as described in Sponsor’s Privacy Policy and Notice at Collection.

For avoidance of doubt, consent to receive marketing text messages from Sponsor does not, by itself, constitute consent to receive telemarketing text messages from unrelated third parties or multiple sellers unless such consent is separately and expressly obtained in a legally sufficient manner.

7. Offer Redemption and Purchase Requirements

Although participation in the Promotion is free, redemption of an offer, voucher, discount, or prize may require a qualifying purchase unless the applicable voucher expressly states otherwise.

Buy-In Required: Unless the specific voucher expressly states “No Purchase Necessary” or equivalent language, any discount, promotional value, or prize connected to game play is redeemable only in connection with the purchase of a standard Bingo session buy-in at 24th Street Bingo.

One Redemption Per Code / Person / Visit: Limit one (1) redemption per unique code, per person, per visit, unless Sponsor expressly states otherwise in writing. Attempts to obtain, generate, redeem, or use multiple codes, identities, devices, accounts, browser sessions, phone numbers, or email addresses to circumvent these limits are prohibited and may result in disqualification.

Presentation Required: The digital voucher or confirmation must be presented to cashier staff at the time of redemption. Sponsor may require identity verification and may refuse redemption where fraud, duplication, tampering, or rule violations are suspected.

8. Prize Validity; Restrictions; Sponsor Discretion

All offers, discounts, vouchers, and prizes are subject to availability, verification, capacity limits, operational needs, applicable law, and Sponsor approval. Sponsor reserves the absolute right, in its sole discretion, to modify, replace, suspend, limit, or cancel any offer, voucher, discount, prize, redemption rule, or Promotion element at any time, with or without notice.

Offers and prizes:

have no cash value unless expressly required by law;
are non-transferable;
may not be sold, assigned, bartered, or exchanged;
may not be combined with any other coupon, offer, promotion, or discount unless Sponsor expressly permits it.

Sponsor reserves the right to refuse, void, or revoke any voucher, offer, or prize where misuse, duplication, technical manipulation, fraud, abuse, ineligibility, or violation of these Terms is suspected.

9. Prohibited Conduct

Any attempt to tamper with, interfere with, automate, manipulate, scrape, reverse engineer, exploit, or undermine the Promotion, website, spin mechanism, redemption process, or related systems is strictly prohibited. Sponsor may disqualify any participant and void any offer or prize if Sponsor determines, in its sole discretion, that the participant has violated these Terms or engaged in fraudulent, deceptive, abusive, or unlawful conduct.

10. Disclaimer of Warranties

The Promotion, website, and all related content, technology, functionality, and offers are provided on an “as is,” “as available,” and “with all faults” basis, without warranties of any kind, express or implied, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, or uninterrupted operation.

Sponsor does not warrant that the website, spin functionality, QR code, or any related systems will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, Sponsor and its parents, subsidiaries, affiliates, owners, members, officers, directors, employees, agents, representatives, contractors, vendors, agencies, successors, and assigns shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or statutory damages arising out of or relating in any way to the Promotion, website, participation, attempted participation, prize acceptance, redemption, or use of any offer or prize, even if advised of the possibility of such damages.

To the fullest extent permitted by law, Sponsor’s total aggregate liability arising out of or relating to the Promotion shall not exceed the lesser of: (a) the actual out-of-pocket amount paid by participant directly to Sponsor in connection with the specific redeemed offer at issue, or (b) fifty dollars ($50.00).

12. Release and Indemnification

By participating, you release, waive, discharge, and agree to indemnify, defend, and hold harmless Sponsor and its parents, subsidiaries, affiliates, officers, directors, employees, agents, contractors, advertising and promotional agencies, technology providers, and representatives from and against any and all claims, demands, actions, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

your participation or attempted participation in the Promotion;
your breach of these Terms;
your misuse or redemption of any offer, voucher, discount, or prize;
technical failures, interruptions, unauthorized access, lost data, or system errors;
your violation of any law or the rights of any third party.

13. Disqualification; Suspension; Termination

Sponsor reserves the right, in its sole discretion, to cancel, suspend, terminate, restrict, or modify the Promotion, or any participant’s access to it, at any time and for any reason, including fraud, abuse, technical failures, legal compliance concerns, business reasons, force majeure events, or any event that impairs the integrity, security, fairness, or proper administration of the Promotion.

14. Governing Law; Venue

These Terms and any dispute arising out of or related to the Promotion shall be governed by and construed under the laws of the State of California, without regard to conflicts-of-law principles. Any action or proceeding arising out of or related to these Terms or the Promotion shall be brought exclusively in the state or federal courts located in California, and each participant consents to the personal jurisdiction and venue of those courts.

15. Severability; Waiver; Entire Agreement

If any provision of these Terms is held unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect. No waiver by Sponsor of any breach or provision shall be deemed a waiver of any other breach or provision. These Terms, together with any applicable Privacy Policy, Notice at Collection, and official Promotion materials, constitute the entire agreement between participant and Sponsor regarding the Promotion.
